Oh my! I'm sorry to hear that you've needed surgery. I hope that your body continues to heal. About your dog, maybe your lawyer can better guide you.

 

Divorce is always a hard thing ... everyone's hurting and it's more about hitting back then common sense. A lot will depend on whose name is on the adoption form and the history of where the dog has lived, if ownership preceded the marriage and who is in the best position to care for it. Best consult your attorney. When my son moved out and got his own place and made him sign a paper saying I had visitation rights.

As for who gets her, it depends. But, typically the one who has taken the most care of the dog's needs and has more paperwork in their name [like walks, vet visits, training classes, etc.] gets a leg up.

 

We both take care of her, but the last month in a half my husband has been walking her and I have been feeding her. She does no training and if we board her. We both take her.
The reason he walked her the last month in a half is cause I had knee surgery and was unable to walk. Otherwise we both walk her and take care of her needs

 

When you are both able to look rationally at the division of your belongings could you perhaps agree joint ownership, like taking week about maybe?
