Having some issues... Seeking advice

First off... A kennel is interested in using by female Labrador to whelp a litter (I bought the bitch at the kennel now interested in using her)

Contact has been kinda splotchy... I mostly talked about the breeding to (who at that time co-owned the kennel, now no longer their...) Lots of information was not either received or sent among us. Both parties are at fault here

So that kinda continued, We got some tests done, OFA Hips and elblows, eyes thorough exam at the local vets....

Now its coming to the last few weeks before Mia's next heat, The owner of the kennel thinks the tests already done to my bitch is sufficient. I disagree...

i would like DM tested, and heart
I would like to know the information of the stud; the tests done and the results (all was shown where pictures of the possible studs)

The kennel has now gotten defensive and threatening when I stated I wanted the above list done before he could use my bitch... To the point of "I can confiscate your dog even though I wont, you have to spay your dog ect"
Apparently the kennel has already been taking deposits for a breeding not yet confirmed... Here was the original contract on purchase of the bitch

-This bitch must not be used for studding or whelping unless done so by their kennel
-Bitch will not be spayed due to show
-If ever I can't take care of the bitch I must return it to the kennel...

At this point it's clear we have two different opinions... I like Quality over quantity, and this kennel is the opposite

I asked the kennel to wait till the heat after this one... So we can sit down talk face to face agree on a breeding contract, and work out anything we dont agree on... But it's this heat or nothing

Sorry for such the long message, I appreciate any help and opinions on this matter. This is a first for me.

There is no advantage to breeding your dog so I would skip it. If the kennel is not worried about breeding healthy pups I would tell them no thank you.

I agree with the others. I would not do it. Also think you would have more problems then you asked for if you went thru with it. Just my opinion.

Sounds like they own your dog more than you do. I would never ever sign a contract like that...seems if you cave in, that from here on out they could demand you breed your dog even if you don't want too.

I'm not sure that just because something is in a contract -- that, that it makes it legal....you might consult a lawyer. Laws change and maybe when a contract if vague it can be made null and void.

There doesn't seem to be anything in the contract about health tests being done for both the dog and the bitch to insure puppies that are going to be healthy, or nothing that protects your bitch in that you want her to be at a certain age for health reasons before breeding...etc....

I think it would be pretty hard for the kennel to confiscate your dog...given the reason in the contract is that can only happen if you can't take care of the dog, which it appears you are able to to do.

Don't give in until you feel right about all this, and again, maybe get a lawyer's advice.

The contractual language above does not state that the dog has to be bred, only that if it is the kennel must be involved. That seems clear and legal to me. But the owner can clearly simply not breed the dog until the tests and so on are satisfactory to her.

This just sounds weird. I highly doubt that this kennel do anything but drag you into more crap (start taking deposits for the NEXT litter, your dog has pregnancy troubles and they stick you with the bills, etcetera). Proceed with caution.

Thanks for the help guys!

I did some research in the end, to find out my Labrador is on an open contract and is under my name on the CKC registration... Meaning I could breed my bitch here at home or lend her out if i AGREE to the plan... CKC told me that on an open contract the breeder has no control over the bitch and can't force me to use in their breeding, nor is there anything saying that I can't breed her here...

The kennel is pissed, and says I ruined my reputation over this.... But healthy dogs mean much more to me then making a quick $$

I have no plans on breeding this female, as she is just a trial/hunting dog there is no benefit for me to breed her, as I specialize in showing GSD's

You definitely made the right choice. If you havent already I would report this breeder to the CKC. That's unethical, bullying behavior they demonstrated to both you and prospective buyers.
