If it's ear mites the dark discharge will pretty easily wipe off but once the ear is clean the dark discharge will be back within a day or two. It also will have a pretty distinctive smell. Ear mites live in the ear canal and not on the tip of the flap like what's shown in your picture.
I'd say the cat managed to scratch your dogs ear a bit and the dog is probably rubbing at it when you aren't looking. Keep it clean and if it starts to look worse then take him to the vet to get it checked. If the kitty will let you clip the tips off his claws, that will keep him from being so easily able to scratch the dog. That's what I did with the 2 kittens I rescued, it cut down on the scratches they were giving me when they played and saved at least some of my skin LOL.
